Commonwealth of Massachusetts General Order, No. 10 --- concerning military draft [May 11, 1863] "Commonwealth of Massachusetts Head Quarters, Boston, May 11th, 1863 GENERAL ORDER, No. 10. Many inquiries have of late been made at these Head Quarters by Town Assessors and others for information in regard to enrolling the Militia of the Commonwealth, the present year. In answer to which, attention is called to "An Act relating to enrollment of the Militia," Chapter 193, approved April 27th, 1863, in these words "Every able-bodied male citizen resident within this Commonwealth, liable to enrollment by the laws of the United States, shall be enrolled in the Militia. All Acts and parts of Acts inconsistent herewith are hereby repealed. This Act shall take effect on its passage." It is the opinion of the Attorney-General that the Act above recited merely repeals the exemptions allowed under the General Statutes, Chapter 13, and that it is the duty of Asessors of Towns and Cities to enroll as militia all able-bodied male citizens between the ages of Eighteen and Forty-Five years, including those now in the service of the United States, discriminating the returns made to this office, the men who are in the service.
